On Wednesday, June 3, the New York Senate passed S.9883A, which creates a three-day waiting period on the transfer of all pistols, shotguns, and rifles. The bill passed 43-18 and advances to the Assembly. While this bill would exclude those with a carry permit, it nevertheless raises serious constitutional issues. Once a person has passed a NICS check, any arbitrary delay in the transfer does nothing more than obstruct the exercise of a constitutional right. NRA sued the state of New Mexico over its 2024 waiting period law and successfully blocked its implementation through a ruling by the U.S. Court of Appeals for the 10th Circuit. New York is on a path to make the same mistake.
