Today, the U.S. Court of Appeals for the Third Circuit granted the state's request for a stay pending its petition for certiorari to the U.S. Supreme Court. This effectively pauses implementation of its ruling in ANJRPC v. Attorney General New Jersey, NRA’s major victory invalidating New Jersey’s bans on “assault firearms” and “large capacity magazines.”
The stay will remain in effect until the Supreme Court acts on the state's petition. The Supreme Court has already granted certiorari in two challenges to bans on commonly owned semi-automatic firearms: Viramontes v. Cook County, which challenges Cook County, Illinois's "assault weapon" ban, and Grant v. Lamont, which challenges Connecticut's similar ban. The Supreme Court may ultimately hold New Jersey's petition until it decides Viramontes and Grant.
While the stay remains in effect, New Jersey residents need to be aware that current state law governing semi-automatic rifles and magazine capacity restrictions is in effect. New Jersey has a long history of overzealous prosecution of gun owners.
