Once again, the U.S. Department of Justice is going on offense for gun owners, this time targeting unconstitutional magazine and gun bans in Colorado and the City of Denver. Anti-gun municipalities who have ignored the Second Amendment for generations are about to discover there is a new sheriff in town.
Today, May 5th, the DOJ filed suit against the City of Denver's "assault weapons" ban, stating the ban fails the "in common use" standard set forth by the Heller decision. Last week, the DOJ put the city on notice and announced the intent to sue Denver over its unconstitutional "assault weapons" ban unless the city entered into negotiations, which would have to include a pledge not to enforce the ban or any similar ban.
This suit comes on the heels of increasingly robust action from the DOJ following the establishment of the Civil Rights Division’s Second Amendment Section, with the DOJ filing a similar suit against Washington, DC's similar "assault weapon" ban, supporting other pro-Second Amendment lawsuits, and putting Virginia's Governor on notice.
