Colorado: Multiple Hearings in House Judiciary Next Week

Next week, the House Judiciary Committee will be hearing multiple firearm related bills, HB26-1021, "The Second Amendment Protection Act" and HB 26-1144 prohibiting the use of certain machines the possession of instructions and digital files to make firearm parts.

House Judiciary Committee - Tuesday February 17

House Bill 26-1021, the "Second Amendment Protection Act." HB 26-1021 is a complete overhaul of Colorado's firearm laws, and includes:

  • Repealing the minimum age of 21 for purchasing a firearm and the three-day waiting period for sales.
  • Removing safe storage requirements (including for firearms in vehicles) and the mandate for background checks in private firearm transfers.
  • Repealing prohibitions on carrying firearms in polling locations, government buildings, licensed child care centers, and on the grounds of schools, colleges, and universities.
  • Repealing provisions regarding unserialized "ghost guns" and limits on ammunition magazine capacity.
  • Eliminating industry standards of conduct and restores previous product liability provisions, ensuring that manufacturers and dealers are not held liable for the actions of third parties or for the inherent potential of a firearm to cause injury unless there is an actual design or manufacturing defect.
  • Repealing requirements for specific merchant codes for retail firearm sales and the necessity of a state permit to deal firearms
  • Reasserting that the regulation of firearms is a matter of statewide concern.
  • Prohibiting local governments from enacting ordinances that are more restrictive than state law regarding the sale, transfer, or possession of firearms.
  • Eliminating the Office of Gun Violence Prevention.
  • Directing the State Treasurer to return fees from the Firearms Training and Safety Course Cash Fund and to return gifts or donations associated with the voluntary waiver of the right to purchase a firearm program, which is also being repealed.

House Judiciary - Wednesday February 18

HB26-1144 attempts to prohibit the private use of 3-D printers and milling machines for manufacturing firearms and firearms parts that are already illegal or restricted under state law. This bill also prohibits the possession of digital instruction files and/or code related to firearm components by private individuals, raising First, Second and Fifth Amendment violation implications. This bill sets forth a dangerous precedent for enforcement and policing of the internet by state officials and raises concerns regarding an individual’s protection from self-incrimination.
