Connecticut: Gun Bills on the Move through the General Assembly

Last week, the Connecticut House passed the Firearms Industry Liability Bill, House Bill 7042 (HB 7042), and the bill will now be transmitted to the Senate for consideration. 

HB 7042 allows civil causes of action to be brought against firearm industry members who allegedly fail to establish, implement, or enforce “reasonable controls,” as defined by the bill. This legislation has the potential to bankrupt local firearm industry members through a litany of lawsuits, inflating business costs in such a fashion that it severely limits opportunities for gun owners to lawfully purchase firearms, ammunition, and components.

Additionally, two other bills passed favorably out of the Joint Judiciary Committee and are now eligible for consideration on the House floor.

Anti-Gun Bill:

In some good news, the Joint Judiciary Committee amended House Bill 7137 (HB 7137) and removed the provisions that would have required a specific Merchant Category Code (MCC) to be assigned to each firearms or ammunition retailer in the state; however, the bill still includes provisions that expand prohibiting categories for certain misdemeanor crimes and juvenile offenses.

Pro-Gun Bill:

House Bill 7194 (HB 7194) clarifies the provisions concerning the discharge of firearms in the case of self-defense or in lawful defense of another person; however, unfortunately the Joint Judiciary Committee amended HB 7194 and it no longer includes provisions allowing the legal transfer of so-called “assault weapons” and “large capacity” magazines between people who already legally possess such firearms or magazines.

Finally, House Bill 7052, raising the magazine restriction limit from 10 rounds to 15 rounds, passed favorably out of the Public Safety and Security Committee and has been referred to the Judiciary Committee for further consideration
