Nevada: Judge Orders Anti-Gun Ballot Initiative Withdrawn and Revised

Last Friday, a Carson City District Judge ordered an anti-gun petition, previously reported here, to be withdrawn and revised.  This petition, authored by “Nevadans for Background Checks,” failed to include a material description of the criminal penalties that would result should this initiative become law.  Earlier this month, a lawsuit was filed challenging this specific wording, encouraging legal action to ensure the true intent of this initiative is communicated to the public.  Potential signers, and the public, will now be aware that “Nevadans for Background Checks” seek to criminalize private firearms transfers.

Before any signatures can be gathered, this petition will need to be rewritten to include an accurate description of the initiative’s intent and re-filed with the Nevada Secretary of State. If it is approved, at least 101,667 valid signatures of Nevada voters would need to be gathered by November 11 for this measure to go to the Nevada Legislature in 2015.  If the state legislature approves that measure within forty days and it is signed by the Governor, it would become law.  If the state legislature fails to approve the measure, it will be placed on the 2016 general election ballot.
