Michigan: Senate Judiciary Committee to Consider Second Amendment Legislation Tuesday

Friday, March 21, 2014

On Tuesday, March 25, the Michigan Senate Judiciary Committee is expected to consider Senate Bill 789 and the Firearms Records Confidentiality Package.

Collectively, the Firearms Records Confidentiality Package would require that information submitted to the government for purposes of firearms licensing, registration, and concealed carry permitting be confidential and not subject to disclosure under the Freedom of Information Act.  This package also ensures that the only accepted disclosure of the information contained in an individual’s firearms records is limited to times when law enforcement has reasonable suspicion to believe that: (1) the firearm was used in the commission of a crime; (2) that the individual whose record is being accessed has committed a crime or is a threat to himself, herself or other individuals; or (3) when the safety of the peace officer is at issue.  These clarifications make firearms records subject to similar constitutional search protections afforded by the Fourth Amendment.

SB 789, sponsored by state Senator Michael Green (R-31), would eliminate county concealed weapon licensing boards and instead transfer all of their duties to the Department of State Police and county clerks.  SB 789 seeks to make the Concealed Pistol License (CPL) process more efficient and cost-effective for gun owners across the Great Lakes State.  SB 789 will include the creation of a true “shall issue” CPL system for law-abiding citizens and a requirement that licenses be issued within 45 days from the date the applicant has fingerprints taken, with penalties for counties that fail to comply with the law.

Using the contact information provided below, please contact members of the Senate Judiciary Committee TODAY and encourage them to SUPPORT the Firearms Records Confidentiality Package and SB 789.
