California: Sunnyvale Voters Approve Anti-Gun Measure C – Lawsuit Imminent

Thursday, November 7, 2013

We applaud the efforts of all who worked tirelessly to oppose Sunnyvale Measure C, and we sincerely thank everyone who did their part to educate their family, friends and fellow gun owners in Sunnyvale about this dangerous affront to the right to keep and bear arms.

Unfortunately on November 5, voters approved Measure C, a batch of extreme and misguided gun control laws that jeopardize the rights of gun owners living in and passing through Sunnyvale.  The newly passed laws, set to take effect in January 2014, will:

  • Ban the possession of “large capacity magazines,” defined as ammunition feeding devices capable of holding more than ten rounds;
  • Mandate that gun owners notify police within 48 hours of the loss or theft of their firearm;
  • Require gun owners to keep firearms locked up when not in the owner’s immediate possession; and
  • Require retailers to maintain detailed records of all ammunition sales for two years.

Violation of any of these laws is a criminal act, punishable by a fine up to $1000, imprisonment in county jail for up to six months, or both.

Measure C was sold as a “gun safety” ordinance to make the citizens of Sunnyvale feel safer, but Measure C will do nothing to reduce Sunnyvale’s already impressively low violent crime rate.   It will erode your inherent right to self-defense and limit your access to legal firearms and ammunition.  Worse yet, the measure’s proponents have pledged to bring these ill-conceived measures to cities throughout California.

The NRA California legal team at Michel & Associates is prepared to file a Second Amendment civil rights lawsuit as soon as possible to prevent portions of Measure C from taking effect.  If you are a resident of Sunnyvale currently in lawful possession of a “large capacity magazine” and are interested in participating in this lawsuit, please contact Michel & Associates as soon as possible.   All communication with the NRA’s attorneys will be confidential, and as a plaintiff you would not be asked to finance any part of this lawsuit.

If you are not interested in joining this lawsuit, but would like to assist in the fight against this attack on law-abiding gun owners, you may donate to the NRA Legal Action Project here.
