Supper club owner Gene Baetens of Hollowwayville, Ill., was awakened by the sound of breaking glass. Carrying a gun, Baetens investigated and found a burglar coming through a window. When the intruder failed to heed the owner's shouts and advanced, Baetens fired, killing the man. The state attorney's office said no charges would be filed against Baetens. Police did arrest the burglar's accomplice, who had fallen asleep in the getaway car.
