"Everything is spinning out of control," quipped one reader when he sent us this WSJ.com Law Blog headline late last week: "Ninth Circuit Recognizes Right to Bear Arms Outside the Home." That federal court, which has appellate jurisdiction over nine Western and Rocky Mountain states, is famously liberal, so that a ruling favorable to gun rights comes as a surprise.
It turns out the 2-1 ruling in Peruta v. San Diego County is true to political type. The judge who wrote it, Diarmuid O'Scannlain, and his concurring colleague, Consuelo Callahan, were appointed by Ronald Reagan and George W. Bush respectively. Dissenter Sidney Thomas was a Clinton appointee.
