The N.J. Star-Ledger Advocates Mandatory Gun Turn-Ins

Echoing a desire repeatedly mentioned by President Obama, last week the New Jersey Star-Ledger’s editorial board declared its support for Australian-style gun controls, most notably mandatory gun turn-ins.  The comments come following the passage of A2895 in the New Jersey State Assembly, which would require the state to have a minimum number of voluntary gun turn-ins each year, using forfeiture funds and private donations.  While conceding that their wish is unlikely to come true, the board insists that unless the voluntary turn-ins are made mandatory, “don’t expect it to make much of a difference.”

Saving the Champagne: Anti-Gunners Not Celebrating AWB Anniversary

Last weekend marked the 10-year anniversary of the federal “assault weapon” and “large” magazine bans’ expiration. True to form, gun control supporters reacted by mischaracterizing what the bans did and by attempting to conceal their plans for future restrictions. For those keeping track, the bans were imposed on September 13, 1994, and expired 10 years later.

NBC Offers Repellent Advice on Appeasing Home Invaders

Americans have a constitutional right to armed self-defense, but they have other choices as well.  The University of Colorado, for example, last year offered the students it sought to disarm with statewide legislation other “crime prevention tactics.”  Options for female students facing rapists included passive resistance,” biting, and self-degradation.  According to one proponent of the bill to ban the lawful carrying of firearms on campuses, such threats are “why we have the whistles.”

Prohibitionists Give up on Semi-Auto Bans? Not So Fast

For the last 25 years, banning so-called “assault weapons” has been at the forefront of the anti-gun agenda.  However, in recent days, an article from ProPublica and a “study” from The Center for American Progress indicated that the gun control establishment is shifting away from advocating for semi-auto bans and towards background checks/registration.  The “coincidence” of these publications appearing days apart hints at what might be public relations scheming, rather than a genuine shift in viewpoint.

Harvard: Millions of Dollars More For Gun Control

Harvard University’s School of Public Health is set to receive a $350 million donation to study “gun violence” and other “complex health threats challenging the U.S. and the world,” CNN reports.  The donation, the largest ever received by the university, is being made by the Morningside Foundation, run by the descendants of Hong Kong real estate tycoon T.H. Chan, for whom the school will be renamed.

House Committee Passes Appropriations Bill That Bans Funding to Implement Arms Trade Treaty

On June 24 of this year, the U.S. House Appropriations Committee passed the State, Foreign Operations and Related Programs Appropriations Bill. Among its provisions is language prohibiting funds to be used for implementing the United Nations Arms Trade Treaty (ATT) prior to full ratification of the treaty by the U.S. Senate. Specifically, section 7061 states: “None of the funds appropriated by this Act may be obligated or expended to implement the Arms Trade Treaty until the Senate approves a resolution of ratification for the Treaty.”

Study: “Assault Weapon” and CCW Restrictions Associated With Higher Murder Rates

In a new study, Mark Gius, of Quinnipiac University’s Department of Economics, has found that between 1980 and 2009, “states with more restrictive CCW laws had gun-related murder rates that were 10% higher” than those of other states. Gius also concluded that state “murder rates were 19.3% higher when the Federal [‘assault weapon’ and ‘large’ magazine] ban was in effect.” Gius says that more research is needed to determine whether these gun control laws contributed to, or merely coincided with, higher rates of crime.

Mississippi Yawning: One Year Later, Dire Open Carry Predictions Prove False

It’s long been a predictable pattern. A state or locality relaxes its restrictions on carrying firearms and doesn’t devolve into the anarchy gun opponents predicted. The latest example comes from Mississippi, where last year a change in the law, and a Mississippi Supreme Court ruling, ensured that law-abiding residents could exercise their right to carry openly without a permit. According to a report in Mississippi’s Clarion-Ledger, after a year of lawful open carry, not much has changed.

Brady Campaign Loses Lawsuit Against Armslist. Again.

The United States Court of Appeals for the Seventh Circuit ruled in favor of the firearms classified website Armslist on Tuesday when it held that, as a matter of law, Armslist could not be liable for the criminal acts of a person who illegally acquired a firearm using the Armslist website.  Alex Vesely, with the support of the Brady Center’s Legal Action Project, sued Armslist on behalf of his sister Jitka, who was killed by Demetry Smirnov using a handgun that had been advertised on Armslist.

BATFE Proposes New “Lost or Stolen” Reporting Requirement for Federal Firearm Licensees

On August 12, 2014, the Department of Justice (DOJ) published a notice proposing an amendment to current Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) regulations requiring Federal Firearms Licensees (FFLs) to report firearms that are lost or stolen in transit.  Under current regulations, FFLs must report theft or loss of firearms within 48 hours of discovery.  However, these new regulations would require that the transferor/sender of a firearm now bear the responsibility for reporting the theft or loss of that firearm within 48 hours.

Friends Indeed: 22 State Attorneys General Join Pro-Second Amendment Brief in SAFE Act Appeal

Amicus curiae (“friend of the court”) briefs have been filed in Nojay v. Cuomo, the appeal from the decision of Judge William Skretny last year that largely upheld New York’s Secure Ammunition and Firearms Enforcement (“SAFE”) Act.  The plaintiffs challenged bans on large-capacity magazines and “assault weapons” (as redefined), the requirement that magazines contain no more than seven rounds, and new rules on ammunition sales, as unconstitutional.  After Judge Skretnty denied most of these claims, the case (decided as New York State Rifle and Pistol Association, Inc. v. Cuomo) was appealed to the U.S. Court of Appeals for the Second Circuit.

Reciprocity Mix-Up Leads to Felony Charges for Philadelphia Mom

On Tuesday, Superior Court Judge Michael Donio declined to dismiss a case for unlawful possession of a firearm against Philadelphia resident Shaneen Allen.  Allen was arrested during a traffic stop last October after she volunteered to the officer that she had a firearm in her car.  She mistakenly believed her Pennsylvania license to carry firearms was valid in New Jersey.  This was hardly an unreasonable assumption, considering that Pennsylvania concealed carry licensees can lawfully carry in over 30 other states.
