New Hampshire: Senate Committee to Hear Mental Health Reform Bill Tomorrow

Tomorrow, the state Senate Judiciary Committee has scheduled an executive session on Senate Bill 244 to consider amending this legislation.  As originally introduced, SB 244 would require the state to transfer records on  individuals who have been “adjudicated as a mental incompetent” or “involuntarily committed to a mental institution” to the FBI’s National Instant Criminal Background Check System (NICS), in compliance with the NICS Improvement Amendments Act (NIAA) of 2007.

The proposed amendment would replace the original legislation with two key elements: 1) establishes a clear restoration of rights procedure and a process to have a record removed from the National Instant Criminal Background Check System (NICS); and 2) establishes a study commission which includes representation from the National Rifle Association, the New Hampshire Firearms Coalition, Gun Owners of New Hampshire, Pro Gun New Hampshire, Second Amendment Sisters New Hampshire Chapter and the National Shooting Sports Foundation, among others -- to examine firearms and mental health issues related to the NICS process.  This commission would report its findings and recommendations for proposed legislation to the Speaker of the House.

It is vital that residents of the Granite State, as well as other individuals across the country, have a procedure to restore their Second Amendment rights when taken away for certain mental health conditions.  This amendment takes positive steps to ensure that New Hampshire has a strong state statute to restore rights while taking the proper steps and precautions to study the inclusion of federally prohibited individuals in the NICS system.  Your NRA-ILA will continue to keep you updated as this legislation progresses through the state Senate, and will be standing guard to ensure this legislation stays within the NIAA guidelines.
