Returning to his Baltimore, Md., apartment to discover two burglars climbing out a window, Randolph Fatherly took a cal. .38 revolver from behind a television set and opened fire. One suspect was shot in the back and fell dead at the bottom of the fire escape. The other burglar, wounded in the arm, surrendered. After hospital treatment, police charged the foiled thief with burglary and homicide. [Homicide charges can in some instances be placed against a suspect charged with a felony in which any person is killed.] Fatherly was not charged.
